Le right to take allows anyone living in a jointly-owned property to install a recharging solution in their parking space at their own expense. As a tenant or owner, you have the right to charge your electric vehicle at home.
- New homes : Since 1 January 2012, newly-built condominiums have been required to equip their car parks with charging stations. Charging points can be individual or collective. In each building, at least 10 % of the parking spaces must be equipped with electric charging points.
- Collective housing already built : Since 1 January 2015, residents of multi-family dwellings that have already been built can request the installation of electrical charging points.

Published in the Journal Officiel on 1 November 2014, the decree no. 2014-1302This means that, subject to certain reservations, you can install your own terminal:
- for the installation of a charging point classic.
- in condominiums with an enclosed or covered car park.
- as soon as it is possible to have an individual metering and billing system for electricity consumption.
In other words, if the bill for your charging point does not affect the other residents of your building and you have a car park, your co-ownership does not have the right to refuse to install your individual charging point. There is no reason to refuse the installation of the charging point as long as the consumption and installation will not cost the other owners anything.
La law is on the side of the occupier of the dwelling, provided that the occupier meets the three conditions explained above.
"The owner, or where applicable, the syndicate of co-owners represented by the managing agent, who intends to oppose work allowing the normal recharging of electric or rechargeable hybrid vehicles with a metering system allowing individual billing of consumption must, on pain of foreclosure, refer the matter to the court of first instance for the location of the building within six months of receipt of the request.
If the general meeting refuses, it is up to the trade union to refer the matter to the Tribunal d'Instance.
Government grants include :
- MaPrimeRénov' (replaces CITE): individuals are eligible for this bonus, which has a ceiling of 20,000 over 5 years for work on a dwelling. - ADVENIR programme Private homeowners, individuals, social landlords and property managers can apply. On the amounts, the applicant can benefit from a aid rate of 50 % and €960 max (for an individual solution) and for a shared solution, a aid rate of 50 % and a maximum of €1,660 per recharging point. There are a number of steps to follow when installing charging points in a condominium:
- Stage 1: the occupant (tenant) submits a request to the co-owner with a description and diagrams (and a copy for the managing agent).
- Step 2: The co-owner has one month to notify the syndic. Your request will then be placed on the agenda for the next general meeting. The syndic will report on the project to all the owners, but no vote will be taken.
- Stage 3: The co-ownership association approves the application.
- Stage 4: either the occupier can start the installation project at his own expense, or the owner wishes to carry out the work. If the work has not started within 6 months, the occupier may proceed with the work.
